Kitty Craft Games LLC Terms of Service

The terms of this agreement ("Terms of Service") govern the relationship between you and Kitty Craft Games LLC ("Kitty Craft Games," "Us," or "We"), a game developer and publisher based at 4445 Corporation Ln. STE 264, Virginia Beach, VA 23462, regarding your use of Kitty Craft Games' games, store, websites, and related services (the "Service"). Use of the Service is also governed by Kitty Craft Games' Privacy Policy and other relevant policies, which are incorporated herein by reference.

Before accessing or using the Service, including browsing any Kitty Craft Games website or accessing a game, you must agree to these Terms of Service and the Privacy Policy. A guest account may be created for you to use the Service, or you may be required to register an account on the Service ("Account"). By using or registering for an Account, or otherwise using the Service, you affirm that you are of legal age in your country of residence. If you are not, your legal guardian must review and agree to these Terms of Service.

BY INSTALLING, USING, OR OTHERWISE ACCESSING THE SERVICE, YOU AGREE TO THESE TERMS OF SERVICE. IF YOU DO NOT AGREE, PLEASE DO NOT INSTALL, USE, OR OTHERWISE ACCESS THE SERVICE. USE OF THE SERVICE IS VOID WHERE PROHIBITED.

For U.S. and Canadian residents, you also agree that disputes must be resolved individually through final and binding arbitration as described in Section 8 ("Dispute Resolution").

Kitty Craft Games reserves the right to change, modify, add, or remove portions of these Terms of Service, its Privacy Policy, and other relevant policies at any time by posting amended terms on the Service. You will be deemed to accept such changes by continuing to use the Service. If at any point you do not agree to any portion of the then-current version of our Terms of Service, the Kitty Craft Games Privacy Policy, or other related policies, your right to use the Service shall terminate, and you must immediately stop using the Service.

1. Using the Service

1.1 Your Right to Use the Service

Subject to your agreement and compliance with these Terms of Service and other Kitty Craft Games policies, you have a non-exclusive, non-transferable, non-sublicensable, revocable, and limited right to access and use the Service for your own non-commercial entertainment purposes.

The following restrictions apply:

  1. Minors: You accept full responsibility for any unauthorized use of the Service by minors, including any use of your credit card or other payment instrument (e.g., PayPal) by minors.

  2. Prohibited Actions: You shall not (or attempt to):

    • Buy, sell, rent, or give away your Account.

    • Create an Account using false identity or information, or on behalf of someone other than yourself.

    • Use the Service if you have previously been removed by Kitty Craft Games, or banned from playing any of its games.

    • Use the Service to advertise, solicit, or transmit commercial advertisements, including chain letters, junk or spam emails, or misleading messages.

1.2 Login Information and Account

You may be required to select a password or use other credentials to access the Account ("Login Information"). You shall not share your Account or Login Information, nor allow others to access your Account, or do anything that jeopardizes its security. If you suspect a breach of security, including loss, theft, or unauthorized disclosure of Login Information, you must immediately notify Kitty Craft Games and modify your Login Information. You are solely responsible for maintaining the confidentiality of your Login Information and for all uses of it, including purchases, whether authorized by you or not.

Kitty Craft Games reserves the right to remove or reclaim usernames at any time for any reason, including claims that a username violates third-party rights.

1.3 Use Limitations

Any violation of these limitations can result in immediate revocation of your right and may subject you to legal liability. You agree not to:

  1. Conflict of Interest: Engage in any act that Kitty Craft Games deems to be in conflict with the spirit or intent of the Service.

  2. Unauthorized Software: Use cheats, bots, hacks, or unauthorized software designed to modify or interfere with the Service.

  3. Game Modification: Modify any files that are part of the Service without express written consent from Kitty Craft Games.

  4. Disruption: Interfere with the normal flow of the Service, including manipulating rankings, exploiting errors, or abusing the design.

  5. Attacks: Conduct or assist in any attack on the Service, including virus distribution, denial of service attacks, or attempts to disrupt others' use of the Service.

  6. Unauthorized Access: Attempt to gain unauthorized access to the Service, accounts of others, or networks connected to the Service.

  7. Offensive Content: Post or share content that is abusive, obscene, defamatory, or offensive, or engages in ongoing toxic behavior.

  8. Infringement: Post material that infringes others' rights, including intellectual property rights.

  9. Reverse Engineering: Reverse engineer, decompile, or decipher the Service's software.

  10. Personal Information: Collect or post anyone's private information, including identification documents or financial data.

  11. Gambling: Use the Service for gambling, betting, or any similar activity with prizes or rewards.

  12. Legal Violations: Use the Service in a manner that violates export controls, anti-money laundering rules, or similar laws.

Kitty Craft Games reserves the right to determine what conduct violates these rules or goes against the intent or spirit of these Terms, taking appropriate actions, including terminating your Account.

1.4 Suspension and Termination of Account and Service

Kitty Craft Games may limit, suspend, terminate, or modify Accounts or access to the Service with or without notice if you violate these Terms or engage in illegal or improper use of the Service. Account termination may result in loss of usernames, benefits, virtual items, and other assets associated with your use of the Service, with no obligation for compensation.

Kitty Craft Games reserves the right to terminate inactive accounts after 180 days.

If the Service or a specific game is discontinued, Kitty Craft Games is not required to provide refunds or compensation.

You may terminate your Account at any time by following the process described on our support page.

2. Ownership

2.1 Games and Service

All rights, titles, and interests in the Service (including games, titles, computer code, artwork, characters, sounds, and other intellectual property) belong to Kitty Craft Games. Kitty Craft Games reserves all rights in connection with its games and Service.

2.2 Accounts

You acknowledge that all rights in and to your Account belong to Kitty Craft Games.

2.3 Virtual Content

Kitty Craft Games owns or has rights to all content in the Service, including virtual items, currency, and features. You agree that you have no ownership or title to any content, including virtual items, and that these are licensed, not sold.

3. User Content

3.1 Submission of User Content

"User Content" includes communications, images, sounds, and information uploaded or transmitted through the Service. By submitting User Content, you affirm that it is accurate, lawful, and free of malicious code. You also acknowledge that personal information within User Content will be processed in accordance with the Privacy Policy.

3.2 Content Screening

Kitty Craft Games assumes no responsibility for user conduct or monitoring content, though it reserves the right to monitor, edit, or remove content at any time. Users bear all risks associated with User Content in the Service.

3.3 Information Use by Others

  1. Public Discourse: The Service may include forums, blogs, and chats where you can share content. Kitty Craft Games is not responsible for others' use of your ideas or information.

  2. Responsibility: You are responsible for the information you post or provide to others through the Service. Kitty Craft Games may remove content at its discretion.

  3. License to Kitty Craft Games: You grant Kitty Craft Games a perpetual, transferable, royalty-free license to use your content, including for derivative works, marketing, and promotions. Kitty Craft Games has no obligation to monitor or enforce intellectual property rights.

3.4 User Interactions

You are responsible for interactions with other users. Kitty Craft Games may intervene in disputes but has no obligation to do so. You agree to release Kitty Craft Games from all claims and damages arising from such disputes.

4. Fees and Purchase Terms

4.1 Purchases

The Service may offer virtual items for purchase, which are licensed, not sold, and subject to management or removal at any time without compensation. All purchases are final and non-refundable, except as required by law.

4.2 Payment of Fees

You agree to pay all fees and taxes incurred through your Account. Kitty Craft Games reserves the right to revise pricing at any time.

5. Updates to the Service

The Service is evolving, and Kitty Craft Games may require acceptance of updates. You may need to update third-party software to access the Service.

6. Disclaimer of Warranties

The Service is provided "as is," without warranties of any kind. Kitty Craft Games does not guarantee uninterrupted service, correction of defects, or freedom from harmful components.

7. Limitation of Liability

Kitty Craft Games is not liable for indirect, incidental, or consequential damages. Its liability is capped at the amount you have paid to Kitty Craft Games in the last six months.

8. Dispute Resolution

For U.S. and Canadian residents:

  1. Mandatory Arbitration: All disputes must be resolved individually through binding arbitration, under the AAA rules.

  2. Class Actions Waived: Arbitration cannot be joined with other proceedings.

  3. Opt-Out: You may opt out of arbitration within 30 days by notifying Kitty Craft Games.

9. Governing Law

For U.S. and Canadian residents: The laws of the State of Virginia govern these Terms, and you consent to the exclusive jurisdiction of Virginia courts.

For users outside North America: The laws of your country govern, and disputes are resolved under its jurisdiction.

10. Miscellaneous

  1. Assignment: You cannot transfer your rights or obligations.

  2. Additional Policies: Other policies, including the Privacy Policy, apply.

  3. Notices: Kitty Craft Games may provide electronic notices.
